**Chapter 169 was the legislation that created the Financial Control Board.  The case that the SEA argued before Judge Sweeney (click for documentation of decision) began in 2003, before the enactment Chapter 169 which created the Control Board.  SEA attorneys argued against Albano's invocation of Chapter 656 to freeze teachers' wages.  Judge Sweeney only ruled on Chapter 656 because the case was filed prior to the enactment of Chapter 169.

The Control Board argues that the $2.1 million awarded by Sweeney is not owed to teachers for 04-05 or 05-06 because Chapter 169 gives them the authority to freeze teachers' salaries for those two years.  Judge Sweeney has indicated that if we should argue against Chapter 169, she would rule on whether the money she has awarded is due to teachers for the 04-05 and 05-06 school years.   The SEA continues to pursue the 04-05 and 05-06 wage freezes at the Labor Relations Board because, unlike the 03-04 case which occurred when we had a contract in effect, the 04-05 and 05-06 cases occurred after the contract had expired.

Please keep the pressure on your legislators so we can resolve this issue.  All we want is a reasonable contract that treats teachers with respect.  Teachers aren't in the business to get rich-they teach because they care about their students.
